Release and Waiver of Liability and Indemnity Agreement
(Read Carefully Before Signing)
In consideration of being permitted to participate in any way in the Martial Arts Program and/or enter any restricted area (defined below), the undersigned acknowledges and agrees as follows:
1. Safety Inspection
The participant or their legal guardian will ensure that the facilities and equipment used are inspected before participation. If the participant believes anything is unsafe, they must notify the officials and refuse to participate. The organiser of the activity must ensure that the environment is reasonably safe and maintained.
2. Restricted Areas
The participant acknowledges that access to restricted areas such as the kitchen, reception area, or power cabinet is prohibited. Entry into these areas is strictly forbidden for participants, and the participant agrees to avoid these areas entirely unless expressly authorized by a representative of the facility.
3. Assumption of Risk
The undersigned acknowledges that there are inherent risks involved in martial arts activities, which may result in injury, disability, or death. These risks include, but are not limited to, actions of other participants, falls, and equipment failure. The participant voluntarily assumes these risks but acknowledges the organiser’s duty of care.
4. Loss of Property
The undersigned acknowledges and agrees that the martial arts facility, its owners, employees, and agents are not responsible for the loss, theft, or damage of any personal property brought into the facility or its surrounding premises. The participant is solely responsible for the care and safekeeping of their personal belongings.
5. Injury Outside the Facility
The undersigned acknowledges that injuries may occur outside the physical premises of the martial arts facility, including but not limited to parking areas, walkways, or other surrounding areas. The participant assumes all risks of injury in such locations and releases the martial arts facility, its owners, employees, and agents from any liability for injury occurring outside the building.
6. Waiver of Claims
To the extent permissible under the Unfair Contract Terms Act 1977, the participant agrees to release the martial arts facility, its owners, employees, and agents from any liability for personal injury, death, or loss of property resulting from their negligence. The organiser cannot exclude liability for gross negligence or willful misconduct.
7. Indemnification
The participant agrees to indemnify and hold harmless the martial arts facility, its employees, and agents against any claims or demands made by third parties arising from the participant’s involvement in martial arts activities.
8. Minors
If the participant is a minor, the legal guardian acknowledges that certain rights cannot be waived under UK law and agrees to the participant’s involvement, assuming responsibility for their safety and participation.
9. Data Protection
The personal data provided in this waiver will be processed and stored in compliance with the UK General Data Protection Regulation (UK GDPR). The information will only be used for the purposes of administering the participant’s involvement in the martial arts program.
10. Scope of Agreement and Exclusion of Liability
This agreement applies to JM Brazilian Jiu-Jitsu Ltd t/a Elite Jiu Jitsu Northern Ireland (hereinafter referred to as “the Facility”). By signing this waiver, the participant acknowledges and agrees that all activities, events, and services provided by the Facility, including but not limited to martial arts instruction, training, and competitions, are subject to the terms outlined herein.
The undersigned expressly agrees that JM Brazilian Jiu-Jitsu Ltd t/a Elite Jiu Jitsu Northern Ireland, its owners, directors, officers, employees, agents, and representatives, are released from any and all liability for injuries, damages, losses, or claims, including but not limited to personal injury, death, or damage to property, arising out of or in connection with the participant’s involvement in any activities conducted by the Facility. This includes liability arising from negligence to the fullest extent permitted by law.
By signing this agreement, the participant acknowledges that they fully understand the scope and intent of this release and that they have waived significant legal rights, including the right to sue JM Brazilian Jiu-Jitsu Ltd t/a Elite Jiu Jitsu Northern Ireland for any injury or loss sustained during participation in the activities.
11. Jurisdiction
This agreement shall be governed by the laws of England and Wales, Scotland, or Northern Ireland, and any disputes arising from participation in the martial arts program shall be subject to the exclusive jurisdiction of the courts in England and Wales, Scotland, or Northern Ireland.
